2022年2月，被告人乔某无意间看见一条“USDT跑分，零成本在家躺赚，日入千元”的消息后，使用自己的银行卡在“欧易”交易平台上买卖“泰达币”。
In February 2022, one of the accused, Joe, inadvertently saw a “USDT running score, zero cost at home, thousands of dollars a day”, using his own bank card to buy and sell “Teda coins” on the “Oe” trading platform.
期间，乔某在明知自己的两张银行卡账户因涉嫌非法转移资金被冻结后，仍继续进行“泰达币”买卖。经核算，乔某涉及转移违法犯罪资金共计487.85万元。银行卡账户共涉及11名被害人被诈骗金额共计18.26万元。乔某从中获利3万元。案发后，乔某某已将赃款退回，并主动到公安机关投案自首。公诉机关以掩饰、隐瞒犯罪所得罪向法院提起公诉。
During this period, Joe, knowing that his two bank card accounts had been frozen on suspicion of illegal transfer of funds, continued to buy and sell “Teda coins”. The sum of $4.885 million was accounted for by Joe, who was involved in the transfer of criminal funds. The total amount of $18.26 million was spent on bank card accounts involving 11 victims.

法院经审理认为，在虚拟币交易型犯罪中，行为人客观上以购买虚拟货币的形式帮助上游犯罪转移资金的行为仍发生在上游犯罪进行中，主观上对于自身所转移的非法资金仅存在概括性明知的情况下，根据主客观相一致的原则，应认定为帮助信息网络犯罪活动罪。依照《中华人民共和国刑法》第二百八十七条之二第一款之规定，判决被告人乔某犯帮助信息网络犯罪活动罪，判处拘役五个月，缓刑六个月，并处罚金人民币5000元；追缴扣押在案的被告人乔某违法所得人民币30000元，上缴国库。
The court considered that, in the case of virtual currency-type offences, the perpetrator's objective contribution to the transfer of funds from the predicate offence in the form of the purchase of virtual currency was still in the course of the predicate offence. Subject to the mere existence of general knowledge of the illicit funds transferred by him, and in accordance with the principle of primary objective consistency, the offence of facilitating the activities of information cybercrime was considered an offence. 对于被告人乔某通过网络虚拟币转移赃款的行为，乔某明知自己两张银行卡账户因涉嫌非法转移资金被冻结，且银行卡收到了违法犯罪资金，但并不明知具体是什么犯罪资金，仅存在概括明知的情况下，仍继续进行“泰达币”买卖。在此期间，上游犯罪一直利用乔某将被害人的钱以购买虚拟货币的形式进行转移，上游犯罪属于正在进行中，根据主客观相一致的原则，以帮助信息网络犯罪活动罪追究被告人乔某某的刑事责任更为适当。
In the case of a transfer of stolen money by an accused person via virtual currency, Joe knew that his two bank card accounts had been frozen on suspicion of illegal transfer of funds and that the bank card had received funds in violation of the law, but did not know exactly what the funds were, and that the sale of the “Tedan currency” continued only with general knowledge. During this period, the predicate offence used Joe's money to transfer the victim's money in the form of a virtual currency. The predicate offence was an ongoing one, and it would be more appropriate, on the basis of the principle of primary objective consistency, to help establish the criminal liability of one of the accused persons for information cybercrime activities.
法官在此提醒广大群众，参与 USDT “跑分”实际上就是在帮助诈骗、赌博等犯罪团伙“洗钱”，可能涉嫌刑事犯罪，需要承担相应的法律后果。切勿为了走捷径赚钱，而走上违法犯罪的道路。
The judge here reminds the public that participation in the USDT “run score” is in fact helping criminal groups such as fraud, gambling, etc. to “money-laundering” and may be suspected of a criminal offence with corresponding legal consequences.
