虚拟货币不受法律保护
Virtual currency is not protected by law
2017年9月，在互联网金融风险专项整治工作框架下，人民银行等七部门联合发布《关于防范代币发行融资风险的公告》，明确虚拟货币交易和代币发行融资平台涉嫌非法发行证券、非法集资，指导各地集中取缔173家平台，此后保持监管高压态势，累计清退38家境内新增平台。监管部门早已明确，任何为中国居民提供虚拟货币交易服务的个人或交易所均涉嫌开展非法金融活动。但不少个人或“交易所”仍铤而走险，提供虚拟货币交易服务。 目前，我国明令禁止交易平台从事法币与虚拟货币的兑换业务、买卖或作为中央对手方买卖虚拟货币、为虚拟货币提供定价和信息中介等服务，按现行监管规定这一要求对境外交易所和场外交易商同样适用。
In September 2017, within the framework of special efforts to regulate financial risks on the Internet, seven departments, including the People's Bank, jointly issued a bulletin on protection against the risk of financing the issuance of money in currencies, which clearly identified virtual money transactions and money distribution financing platforms as being suspected of illegal issuance of securities, illegal fund-raising, and directed the centralization of 173 platforms in various regions. Since then, the regulatory authorities have maintained a high level of control over the accumulation of 38 new platforms in China.

《关于防范代币发行融资风险的公告》第一条 准确认识代币发行融资活动的本质属性代币发行融资是指融资主体通过代币的违规发售、流通，向投资者筹集比特币、以太币等所谓“虚拟货币”，本质上是一种未经批准非法公开融资的行为，涉嫌非法发售代币票券、非法发行证券以及非法集资、金融诈骗、传销等违法犯罪活动。有关部门将密切监测有关动态，加强与司法部门和地方政府的工作协同，按照现行工作机制，严格执法，坚决治理市场乱象。发现涉嫌犯罪问题，将移送司法机关。代币发行融资中使用的代币或“虚拟货币”不由货币当局发行，不具有法偿性与强制性等货币属性，不具有与货币等同的法律地位，不能也不应作为货币在市场上流通使用。
Article 1 of the Proclamation on Protection against the Risk of Money Issued, which provides an accurate understanding of the essential attributes of the activities involved in the financing of money issues, refers to the so-called “virtual currency” that the financing subjects collect from investors by means of irregularities in the sale, circulation and circulation of money in currencies. It is essentially an unauthorized act of illegal public financing, suspected of illegal distribution of currency coupons, illegal distribution of securities and illegal collection of funds, financial fraud, and distribution. The relevant authorities will closely monitor developments and strengthen synergies with the work of the judiciary and local governments, enforce strict law enforcement in accordance with existing working mechanisms, and firmly address market distortions.
